A 41-year-old Cork man spat into a shopkeeper’s face when he was being deflected from shoplifting at the premises and he was jailed today for five months as the victim described the offence as the lowest of the low.
Daniel Walsh, of 15 Charles Daly Road, Ballyphehane, Cork, who has mental health problems compounded by alcohol, pleaded guilty to assaulting the shopkeeper.
A victim impact report was presented at Cork District Court where Judge Mary Dorgan quoted from it as she imposed sentence: “I have been working in Cork city for 22 years and no one has ever spat in my face. The fact that my mouth was open and the culprit’s saliva entered my mouth made me feel very sick physically and also deeply upset me as I felt violated.
“I was asking the culprit to stop stealing from my shop on Oliver Plunkett Street and, in my opinion, spitting in someone’s face is the lowest of the low.”
Judge Dorgan agreed with the view taken by the victim.
Sergeant John Kelleher said that the accused had 98 previous convictions including numerous counts for engaging in threatening behaviour and six for assaults.
