Niall De Baroid, aged 63, of 3, Murphy’s Gardens, Turner’s Cross, Cork, pleaded guilty at Cork Circuit Criminal Court to a count of assault causing harm to Garry Doocey on April 10, 2014 and producing a knife on the occasion.
Detective Garda Noel Maxwell testified that shortly after noon that day a man had an epileptic fit outside Tony’s Bistro on North Main Street. The defendant and the injured party went to his assistance . The ambulance arrived and brought the man away for medical attention.
There was an exchange of words then between De Baroid and Mr Doocey about how they had cared for the man having the fit.
“Mr De Baroid took a penknife from his pocket and stabbed Mr Doocey in the throat. He had to be taken to Cork University Hospital,” Det Garda Maxwell said.
Niall De Baroid had no previous convictions of any kind and was not known to gardaí. Donal O’Sullivan, defending, submitted a lengthy psychiatric report on the accused.
Judge Donagh McDonagh said he would like to consider a judgement from the Court of Criminal Appeals related to non-custodial sentences only being imposed in knife crimes in exceptional circumstances. The judge also said he wanted guidance from the psychiatrist who dealt with the accused.
Sentencing was adjourned until Friday.
